- Owners confirm they have full legal rights to list, market, and rent the property.
- Any changes to the property, pricing, or availability must be updated promptly to ensure accuracy for travelers.
Content Ownership & Usage Rights
- All video and photography produced by Tobermory 360 remain the intellectual property of Tobermory 360.
- Owners receive a non‑exclusive license to use the produced content on their own rental platforms (Airbnb, VRBO, Booking.com, personal website, social media).
-Tobermory 360 may use any produced content for marketing, promotional materials, platform showcases, and advertising.
Video Production Terms
- Video production fees are non‑refundable once filming has taken place.
- Owners are responsible for ensuring the property is clean, staged, and ready at the scheduled filming time.
-Rescheduling within 48 hours of the appointment may result in a rescheduling fee.
- Tobermory 360 reserves the right to decline filming if the property is not in suitable condition.
Listing Fees & Paid Upgrades
- Basic listings on Tobermory 360 are free.
- Paid upgrades (video tours, photography, featured placement, priority ranking) are billed at the time of purchase.
- Featured placement or priority listing upgrades renew monthly unless cancelled by the owner.
- Pricing may change over time; owners will be notified of any adjustments.
Early Access Program
- Early access spots are limited and offered on a first‑come, first‑served basis.
- Early access participants may receive discounted video rates, bonus visibility, or promotional placement.
- Tobermory 360 may adjust or discontinue early access benefits at any time as the platform grows.
Accuracy, Responsibility & Liability
- Tobermory 360 is not responsible for booking issues, cancellations, guest behavior, or disputes between owners and renters.
- Owners are solely responsible for ensuring their property complies with all local laws, permits, zoning rules, and rental regulations.
- Tobermory 360 is not liable for property damage, safety issues, or rental outcomes.
- Owners agree that all information they provide is truthful and not misleading.
Listing Removal or Suspension
- Tobermory 360 may remove or suspend listings that contain false information, unsafe conditions, inappropriate content, or violations of platform guidelines.
- Owners may request removal of their listing at any time.
- Removed listings may lose visibility, ranking, or promotional placement without refund.
Communication & Privacy
- By listing a property, owners agree to receive communication regarding updates, promotions, scheduling, and platform improvements.
- Tobermory 360 does not sell or share owner contact information outside of operational needs.
General Terms
- Tobermory 360 may update these terms at any time to reflect platform growth or operational changes.
- Continued use of the platform constitutes acceptance of updated terms.
- Owners are encouraged to review terms periodically.
No Guarantees or Performance Promises
- Tobermory 360 does not guarantee bookings, inquiries, visibility levels, rental income, or any specific performance outcomes.
- While high‑quality video tours typically increase engagement, results may vary based on market conditions, seasonality, pricing, property quality, and owner responsiveness.
- Tobermory 360 provides marketing exposure only; all rental success depends on factors outside our control.
- No statements made by Tobermory 360, verbally or in writing, should be interpreted as a promise of financial results or booking volume.

Tobermory 360 provides information and visual content for discovery purposes only. Visitors who choose to visit any property, restaurant, or location featured on our platform do so at their own risk. Tobermory 360 is not responsible for the condition, safety, availability, pricing, service quality, or overall experience at any listed location. By using the platform, visitors agree to hold Tobermory 360 harmless from any claims, damages, injuries, losses, or disputes that may arise from visiting or interacting with any featured property or business.
